PAGA Claims – A Growing Threat for Employers
Due to the number of questions on the topic of PAGA at SDEA’s Annual Employment Law Update in January, we are happy to welcome back Evan Pena from Paul, Plevin Sullivan and Connaughton.
What is PAGA? The Private Attorney General Act, or PAGA, is a California statute that enables workers to file lawsuits against employers for certain labor violations. Employees act as “private attorneys general.” They can pursue civil penalties as if they were a state agency.
In addition to bringing individual or class-action claims, aggrieved employees can sue under PAGA for alleged labor violations on behalf of themselves and other workers. PAGA was intended to deputize citizens as private attorneys general to enforce the labor code in light of the state government's limited resources.
In this roundtable, Evan will discuss what types of claims fall under PAGA, some recent cases and what employers can do to reduce their risk.
This is not a “big employer” problem. SDEA is hearing from our small- to mid-size employers that are facing PAGA claims. Join us for this informative discussion.
